Imerys SA is urgent forward in an effort to get out from below lawsuits over its U.S. mining operation, Imerys Talc America Inc., over the protests of health-care firm Johnson & Johnson .
The Imerys talc-mining enterprise, which provided talc for Johnson’s Baby Powder, had been hit with lawsuits claiming the product brought on most cancers. It was positioned into chapter 11 protection in 2019 and sold in 2020 for $223 million, with the proceeds earmarked for a belief to pay most cancers claims. It is now attempting to win court docket permission to search creditor approval of its chapter compensation plan.
Johnson & Johnson, which has denied legal responsibility and is combating the lawsuits, says Imerys Talc’s chapter is an improper effort to immunize the mining firm’s French father or mother, and make it simpler for most cancers victims to sue Johnson & Johnson.
“J&J believes in the safety of its products,” mentioned Ronit Berkovich, a lawyer for Johnson & Johnson.
Imerys SA didn’t reply to a request for remark.
